General Terms and Conditions
Aurelion Diamonds is operated by EC Aurelion Ltd.
1. Definitions
In these General Terms and Conditions, the following terms shall have the meanings set out below:
Company: EC Aurelion Ltd, trading as Aurelion Diamonds, a company incorporated under the laws of the Republic of Cyprus.
Customer: Any natural person acting for purposes outside their trade, business or profession.
Agreement: Any distance contract concluded between the Company and the Customer.
Products: Diamond jewellery, including lab-grown and natural diamonds, offered by the Company.
Website: The online store operated by the Company.
2. Applicability
2.1
These General Terms and Conditions apply to all offers, orders and Agreements concluded via the Website.
2.2
Deviations from these terms are only valid if expressly agreed in writing by the Company.
2.3
Mandatory consumer protection laws of the Customer’s country of residence shall prevail where applicable.
3. The Offer
3.1
All offers on the Website are non-binding and subject to availability.
3.2
Product descriptions, images and specifications are provided as accurately as possible. Minor deviations may occur due to craftsmanship, photography or screen settings.
3.3
Obvious errors or mistakes in pricing, descriptions or product information do not bind the Company.
4. Formation of the Agreement
4.1
The Agreement is concluded when the Customer places an order via the Website and receives an order confirmation by email.
4.2
The Company reserves the right to refuse or cancel orders in case of errors, including pricing errors caused by technical or human mistakes, suspected fraud or force majeure.
5. Prices and Taxes
5.1
All prices are stated in euros (€), unless stated otherwise.
5.2
Prices include VAT where applicable, in accordance with EU VAT regulations.
5.3
Any additional costs, such as shipping costs or customs duties (if applicable), will be clearly stated before the order is placed.
6. Payment
6.1
Payment must be made using the payment methods offered on the Website.
6.2
Orders will only be processed after full payment has been received.
6.3
The Company uses secure third-party payment providers. The Company is not responsible for failures, interruptions or delays caused by these providers.
7. Delivery
7.1
Products are delivered to the address provided by the Customer.
7.2
Estimated delivery times are indicative only and do not constitute a guarantee.
7.3
The risk of loss or damage passes to the Customer upon delivery.
7.4
Every shipment is fully insured for its purchase value, tracked and delivered against signature. Further details are set out in the Shipping Policy.
8. Right of Withdrawal
8.1
The Customer has the right to withdraw from the Agreement within 14 days without giving any reason.
8.2
The withdrawal period expires 14 days after the day on which the Customer, or a third party other than the carrier indicated by the Customer, receives the Product.
8.3
To exercise the right of withdrawal, the Customer must notify the Company of their decision by means of a clear statement, for example by email to concierge@aureliondiamonds.com. No prior authorisation is required. The right of withdrawal may also be exercised before delivery.
9. Personalised and Individually Made Items
9.1
A Product ordered using the standard Collection options remains a normal Collection product, even when it is crafted after the order. Choosing an available carat size, gold colour or standard ring size does not, by itself, make a Product personalised.
9.2
The right of withdrawal is excluded only where a legal exception applies, in particular for goods made to the Customer's individual specifications or clearly personalised, such as jewellery with a personal engraving, an individual Bespoke design or a modification outside the standard Collection options. Any applicable exception is explained to the Customer before the order is placed.
9.3
A Product from The Vault is not excluded from the right of withdrawal simply because it is unique or has already been crafted.
9.4
These provisions are in accordance with applicable EU consumer law, including Article 16(c) of Directive 2011/83/EU.
10. Returns and Refunds
10.1
The Customer must send the Product back within 14 days after notifying the Company of the withdrawal, packed securely and complete with certificates, grading reports and documentation.
10.2
In the event of a valid withdrawal, the Company reimburses all payments received, including the costs of standard delivery, without undue delay and no later than 14 days after being informed of the withdrawal. The Company may withhold reimbursement until the Product has been received or proof of return shipment has been provided, whichever occurs first.
10.3
For a change-of-mind return, the Customer bears the direct cost of returning the Product. This does not apply where a Product is faulty, incorrectly supplied or does not conform to the Agreement.
10.4
Eligible non-personalised Collection jewellery additionally qualifies for a voluntary 30-day exchange service, as described in the Return & Refund Policy. This service does not restrict the Customer's statutory rights.
11. Conformity and Warranty
11.1
The Company guarantees that the Products conform to the Agreement and applicable legal requirements.
11.2
Statutory warranty rights under EU consumer law remain unaffected.
12. Liability
12.1
The Company shall not be liable for indirect, incidental or consequential damages.
12.2
Nothing in these terms limits liability for intent, gross negligence or mandatory statutory liability.
13. Force Majeure
13.1
The Company shall not be liable for failure to perform its obligations due to circumstances beyond its reasonable control.
14. Intellectual Property
14.1
All intellectual property rights relating to the Website, brand, designs, images and content belong to the Company.
14.2
Unauthorized use, reproduction or distribution is strictly prohibited.
15. Complaints and Disputes
15.1
Complaints should be submitted within a reasonable time after discovery.
15.2
This does not affect the Customer's right to refer a dispute to the competent consumer protection authorities or courts.
16. Governing Law and Jurisdiction
16.1
These General Terms and Conditions are governed by the laws of the Republic of Cyprus.
16.2
Any disputes shall be submitted to the competent courts of Cyprus, unless mandatory consumer protection laws provide otherwise.
17. Amendments
17.1
The Company reserves the right to amend these General Terms and Conditions at any time.
17.2
The version applicable at the time of the order shall apply.
