General Terms and Conditions
Aurelion Diamonds is operated by EC Aurelion Ltd.
1. Definitions
In these General Terms and Conditions, the following terms shall have the meanings set out below:
Company: EC Aurelion Ltd, trading as Aurelion Diamonds, a company incorporated under the laws of the Republic of Cyprus.
Customer: Any natural person acting for purposes outside their trade, business or profession.
Agreement: Any distance contract concluded between the Company and the Customer.
Products: Diamond jewellery, including lab-grown and natural diamonds, offered by the Company.
Website: The online store operated by the Company.
2. Applicability
2.1
These General Terms and Conditions apply to all offers, orders and Agreements concluded via the Website.
2.2
Deviations from these terms are only valid if expressly agreed in writing by the Company.
2.3
Mandatory consumer protection laws of the Customer’s country of residence shall prevail where applicable.
3. The Offer
3.1
All offers on the Website are non-binding and subject to availability.
3.2
Product descriptions, images and specifications are provided as accurately as possible. Minor deviations may occur due to craftsmanship, photography or screen settings.
3.3
Obvious errors or mistakes in pricing, descriptions or product information do not bind the Company.
4. Formation of the Agreement
4.1
The Agreement is concluded when the Customer places an order via the Website and receives an order confirmation by email.
4.2
The Company reserves the right to refuse or cancel orders in case of errors, including pricing errors caused by technical or human mistakes, suspected fraud or force majeure.
5. Prices and Taxes
5.1
All prices are stated in euros (€), unless stated otherwise.
5.2
Prices include VAT where applicable, in accordance with EU VAT regulations.
5.3
Any additional costs, such as shipping costs or customs duties (if applicable), will be clearly stated before the order is placed.
6. Payment
6.1
Payment must be made using the payment methods offered on the Website.
6.2
Orders will only be processed after full payment has been received.
6.3
The Company uses secure third-party payment providers. The Company is not responsible for failures, interruptions or delays caused by these providers.
7. Delivery
7.1
Products are delivered to the address provided by the Customer.
7.2
Estimated delivery times are indicative only and do not constitute a guarantee.
7.3
The risk of loss or damage passes to the Customer upon delivery.
8. Right of Withdrawal
8.1
The Customer has the right to withdraw from the Agreement within 14 days without giving any reason.
8.2
The withdrawal period expires 14 days after the day the Customer receives the Product.
8.3
To exercise the right of withdrawal, the Customer must notify the Company of their decision by means of a clear statement.
9. Exceptions to the Right of Withdrawal
9.1
The right of withdrawal does not apply to:

Custom-made or bespoke jewellery

Products made according to Customer specifications
-
Engraved or personalized items
9.2
These exclusions are in accordance with applicable EU consumer law.
10. Returns and Refunds
10.1
Returned products must be unused, undamaged and returned in their original packaging.
10.2
Refunds will be processed within 14 days after receipt and inspection of the returned product.
10.3
The Company may withhold reimbursement until the product has been received or proof of return shipment has been provided.
11. Conformity and Warranty
11.1
The Company guarantees that the Products conform to the Agreement and applicable legal requirements.
11.2
Statutory warranty rights under EU consumer law remain unaffected.
12. Liability
12.1
The Company shall not be liable for indirect, incidental or consequential damages.
12.2
Nothing in these terms limits liability for intent, gross negligence or mandatory statutory liability.
13. Force Majeure
13.1
The Company shall not be liable for failure to perform its obligations due to circumstances beyond its reasonable control.
14. Intellectual Property
14.1
All intellectual property rights relating to the Website, brand, designs, images and content belong to the Company.
14.2
Unauthorized use, reproduction or distribution is strictly prohibited.
15. Complaints and Disputes
15.1
Complaints should be submitted within a reasonable time after discovery.
15.2
Customers may also use the EU Online Dispute Resolution (ODR) platform.
16. Governing Law and Jurisdiction
16.1
These General Terms and Conditions are governed by the laws of the Republic of Cyprus.
16.2
Any disputes shall be submitted to the competent courts of Cyprus, unless mandatory consumer protection laws provide otherwise.
17. Amendments
17.1
The Company reserves the right to amend these General Terms and Conditions at any time.
17.2
The version applicable at the time of the order shall apply.
